Qualification for Cancellation of Removal
What is cancellation of removal?
According to Homeland Security, cancellation of removal is: "A discretionary benefit adjusting an alien's status from that of deportable alien to one lawfully admitted for permanent residence." In order to qualify for cancellation of removal, there are a number of stipulations that must be met. This includes continuous physical presence in the United States for 7 years, having good moral character during this time and that removal from the country would result in extreme hardship to the person's spouse, children and/or parents.
While the term "good moral character" is vague, there are a number of circumstances that are observed to see if someone is not of good character. Such items include:
- Habitual drunkenness
- Engaging in prostitution or alien smuggling
- Being suspected of trafficking controlled substances
- Having 2 or more gambling offenses
- Having been confined to prison for 180 days or more
- Committing an aggravated felony
