Legal Help for Fiancé Visas in Albuquerque

The fiancée visa, also known as a K-1, allows U.S. citizens to bring their foreign national fiancées into the country for the purpose of getting married. This visa does not act as a green card and does not allow one's fiancée to remain in the United States indefinitely. It enables a fiancée to enter the country only one time within six months of its issuance. Once a citizen has brought a fiancée into the country using this visa, the two individuals have 90 days in which to get married. If a marriage does not occur, the fiancée must leave before the 90-day period expires. If a marriage does occur, the two individuals must apply for an adjustment of status so that the fiancée can be considered a legal permanent resident.

Fiancé Visa Eligibility

There are four primary qualifications that individuals seeking a K-1 fiancée visa must meet. These qualifications are:

  • An individual requesting the visa for a fiancée must be a U.S. citizen (legal permanent residents are not eligible to obtain K-1 visas for spouses)
  • The individual must have met the fiancée within two years of applying for the visa
  • The individual and the fiancée must have a genuine intention to marry within 90 days of the fiancée entering the U.S.
  • The individual and the fiancée must be legally able to get married
