Types of Work Visas

There are visas that cater to individuals who wish to live and work in the United States. These work visas are divided into a variety of classifications, and the appropriate classification for an individual will depend on the position in question, as well as the person's job duties and qualifications. Examples of common work visas include:

  • H-1B - This classification is for workers who have completed the equivalent of a United States bachelor's degree or higher. Such workers must intend to work in a specialty occupation that involves both theoretical and practical application of a specialized area of knowledge.
  • L-1A - This is for intracompany transfers who have worked in an executive or managerial position and will continue to do so in their new position. They must have worked abroad for a branch, affiliate, subsidiary, or parent of the company for at least one year out of the preceding three.
  • L-1B - This is for intracompany transfers who will employ specialized knowledge regarding their employer's products, procedures, or services. They must have worked abroad for a branch, affiliate, subsidiary, or parent of the company for at least one out of the three preceding years.
  • O-1 - This classification is for people with extraordinary abilities in education, science, art, athletics, or business, or those with extraordinary accomplishments in motion pictures or television who intend to continue working in that field.
  • TN - This is for Canadian or Mexican nationals who intend to work in a professional occupation in the U.S., and possess the required qualifications for that occupation.
  • E-1 - This is for nationals of countries with a Bilateral Investment Treaty or Treaty of Friendship, Commerce, and Navigation with the U.S. These individuals must intend to conduct substantial trade between their country and the U.S.
  • E-2 - This is for nationals of countries who possess the above treaties with the U.S. who wish to administer and develop the operations of a business enterprise in which significant capital has been invested.
